Introduced into UK law in 2006, the Waste Electrical and Electronic Equipment Directive (WEEE Directive) was specifically designed to address the millions of tonnes of reclaimable electronics and electrical equipment that were being dumped into landfill each year.

Electronic equipment often contains harmful heavy metals such as cadmium, mercury and lead, which can cause serious damage to the environment when placed into landfill or incinerated. Hence, the WEEE Directive was put in place to set out responsibilities for manufacturers to ensure that at least 85% of the materials used in their products are recycled by appropriately vetted and certified waste management firms.

In addition to reducing the volume of equipment placed into landfill each year, the WEEE Directive also has another reason for tackling this highly wasteful practice: the fact that we were quite literally burying a huge amount of wealth and resources in the ground.

The 1998 Data Protection Act gives specific instruction that any personal data held by a company must be protected against unlawful and/or unauthorised access. This legal requirement extends not only to data on “live” systems but also any that might be held in any old IT equipment or electronic storage medium which is to be disposed of.

The theft and sale of such data is a highly lucrative and fast growing sector of the ‘black market’ – with organised criminal gangs using increasingly sophisticated methods and expert knowledge to help them steal valuable information. One of the areas on which they prey is accessing data from IT equipment that has become damaged or been disposed. Don’t assume because a laptop or PC is broken that the data inside is irrecoverable to someone in the know. The only safe option is to have the hard drive professionally removed and either wiped or securely destroyed.

Since 1995 this wide-ranging and comprehensive set of legislation has set out the legal responsibilities and processes by which all individuals, companies and organisations in the UK must abide by when disposing of rubbish.

In the past virtually anything could be dumped in landfill sites with little or no consideration for problems or potential hazards this might represent for the future. Thankfully, we now understand the environmental issues landfill sites create and can now work towards better solutions for dealing with discarded waste.
